Terms of Service

These Terms of Service ("Terms") govern your use of the Kyuria website and services operated by Kyuria ("we," "us," "our"). By accessing or using the service, you agree to be bound by these Terms.

1. The Service

Kyuria is a communication intelligence platform. Coaches, consultants, and team leaders create rooms, invite team members to complete a personality assessment, and receive communication guides for every relationship on the team. Guides are generated by our system and reviewed by a coach before delivery to participants.

2. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately if you become aware of unauthorized use of your account.

Participants may be invited to the service by a coach or team leader. By completing an assessment, participants agree to these Terms and our Privacy Policy.

3. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to the service or its systems
• Interfere with or disrupt the service
• Scrape, crawl, or use automated means to access the service without permission
• Misrepresent your identity or impersonate another person
• Use communication guides to harass, discriminate against, or harm others
• Redistribute, resell, or commercially exploit communication guides outside the intended use (delivering them to the team for which they were generated)

4. Payments and Refunds

Room purchases. Rooms are purchased individually or through subscription credits. Prices are displayed at checkout and processed through Stripe. All prices are in US dollars unless otherwise stated.

Subscriptions. If you subscribe, you will be billed on a recurring basis. You may cancel at any time, and your subscription will remain active through the end of the current billing period. Unused room credits do not roll over after cancellation.

Refunds. If you purchase a room and no participants have completed assessments, you may request a full refund within 14 days. Once assessment data has been collected or guides generated, the room purchase is non-refundable, as we have incurred processing and generation costs. Refund requests should be sent to help@kyuria.com.

5. Intellectual Property

Our content. The Kyuria platform, including its design, code, algorithms, and the structure and methodology of the communication guides, is our intellectual property.

Your data. You retain ownership of your assessment responses and personal data, as described in our Privacy Policy. By using the service, you grant us a limited license to process your data for the purpose of providing the service.

Generated guides. Communication guides are generated by our system using your data. Coaches may use the guides they have purchased within the context of their professional practice with the team for which the room was created. Bulk export, systematic reproduction, or use of guides to build competing products is prohibited.

6. Coach Responsibilities

Coaches who use Kyuria to serve their clients are responsible for:

• Obtaining appropriate consent from team members before inviting them to the service
• Reviewing generated guides before delivering them to participants
• Using guides ethically within the scope of their professional practice
• Not misrepresenting AI-generated content as solely their own original analysis

7. AI-Generated Content

Communication guides are generated with the assistance of artificial intelligence. While guides are grounded in validated personality science and statistical confidence thresholds, they are not a substitute for professional psychological assessment, clinical diagnosis, or therapy. Guides are designed as conversation starters and practical tools, not definitive characterizations of any individual.

We make no guarantee that every statement in a guide will be accurate for every relationship. Where the data is insufficient to support a claim, the guide is designed not to make it. Coaches are encouraged to edit guides to reflect their professional judgment.

8. Limitation of Liability

The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim arising from the service is limited to the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may close your account at any time by contacting us. Upon termination, your right to use the service ceases. Data deletion follows the procedures described in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts located in Bucks County, Pennsylvania.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the service after changes constitutes acceptance of the updated Terms.
